ACCOUNT INFORMATION

ABC collects information about you that is provided in conjunction with your purchase of services from one of ABC’s health club clients, including information provided on your health club membership agreement(s) and personal training agreement(s). Information about you is typically obtained from the agreement you sign with the club from whom you purchase services. Your personal information may also be collected from you when you provide information directly to ABC in any manner, or when you update account or contact information at the club or online. The information ABC collects about you may include your name, postal address, email address, phone numbers, bank account or credit card information, audio recordings of phone calls with you or made in relation to your account, photographs voluntarily taken at the club, and e-mail correspondence with you or in relation to your account. ABC collects such personal information about you for the purpose of processing and collecting payments owed by you to the club, to contact you in relation to your health club account, and to otherwise provide third party payment processing and administrative services to your club. ABC uses information it collects to communicate with health club members, collect payments owed to its health club clients, and maintain up to date account information for members. Participant (“Participant”, “you” or “your”) agrees to be bound by these Auto Renew Terms and Consent to Membership Agreement (“Terms”) with respect to all services provided by Club Fitness (“Services”). All references to “Club Fitness” in these Terms mean Club Fitness, Inc., its parents, affiliates or subsidiaries (“Club Fitness” or “we” or “us”) providing Participant the Services, as well as third parties Club Fitness may retain to provide the Services.

By checking the appropriate box, you give your express, informed consent and agree to pay the applicable dues, as well as the increased dues amount and annual membership fee, any new, additional or increased taxes imposed as set forth herein, and any past due amount owed, by automatic payments billed to a checking, saving, credit or debit card account, as identified in the attached Exhibit A. Once the automatic deductions begin you will continue to be billed until a 30-day notice of your intent to terminate this Agreement is received as set forth herein. Upon completion of your installment payment(s) your membership shall automatically renew until you terminate your membership in accordance with these Terms. Your last billing will occur within 30 days of your termination notice being received, as well as being billed for all past dues amount owed. 

MEMBER’S RIGHT TO CANCEL: You may cancel, your Membership Agreement online, in writing by certified mail, return receipt requested, to Club Fitness 7055 Mexico Road Box 1210, St. Peters, MO 63376 or by personally visiting any Club Fitness location during business hours and informing the staff of your intention to terminate your Membership Agreement. Any notice of termination submitted in person shall not be valid unless you receive electronic or written receipt and confirmation of termination. Please retain your electronic or written receipt and confirmation of termination for your records. A thirty (30) day notice period is required for termination of your Membership Agreement. You are required to pay the annual membership fee, as set forth in Exhibit A, if it falls within this thirty-day notice period.  You will also be responsible for any past due amounts owed. Your membership must be active (i.e., not frozen) for a termination to be processed.
